How Does Mediation Work?

In mediation, members of a divorcing couple work together to bring about a settlement they can both live with. They are assisted by a mediator, who serves only to help the process along and suggest compromises. A mediator is not a judge, and does not make decisions for the couple. The lawyers advising the members of the couple do not usually attend the mediation sessions.

Because the people divorcing must make all the decisions themselves, it allows them to take control of all outcomes of the divorce, from child custody and visitation to spousal support. Once they work out an agreement on all aspects, then the mediator can take care of the legal forms and make it official. A court appearance is often not necessary.
